隱私保護政策

橫河電機(中國)有限公司和母公司橫河電機株式會社(以下簡稱“橫河集團”或“我們”。)認為您的隱私很重要。為確保您在利用Webex Event軟件服務及在Webinar網絡平台上參與我們組織的市場、直播、培訓、研討、會議等活動時,獲得積極的用戶體驗,我們將通製《隱私保護政策》(以下簡稱“本政策”)幫助您了解我們收集、使用、存儲和共享個人訊息的情況,以及您所享有的相關權利。

 

一、 我們如何收集和使用您的個人訊息

在您使用我們的網站、產品及與我們互動時,我們可能收集關於您的數據,包括您的姓名、電話號碼、傳真號碼、郵件地址、國籍、時區、使用語言、郵編、詳細住址、公司名、公司網址、職務及其他《個人訊息安全保護規範》中所定義的個人訊息(以下簡稱“個人訊息”)。

 

我們收集您個人訊息出於以下原因:

與您進行網絡研討會;

向您推送特定網絡研討會的訊息;

向您推送我們的產品、服務、解決辦法或成功案例;

進行市場數據分析、市場推廣服務;

銷售,包裝,交付我們的產品和開具發票;

提供售後服務,維護和支持;

改善我們的網站和其他在線服務。

 

如果您選擇向我們提供第三方的個人訊息(例如在我們舉辦的線上會議邀請中追加第三方的姓名、電子郵件和電話號碼),表示您事先獲得了第三方的許可。

 

二、 我們如何委托處理、共享、轉讓、公開披露您的個人訊息

 

  1. 委托處理

我們向您提供產品、服務或與您進行互動時,部分內容可能通製我們的合作夥伴提供。 對我們委托處理個人訊息的公司、組織和個人,我們會與其簽署嚴格的保密協定,要求他們按照我們的要求、本政策以及其他任何相關的保密和安全措施來處理個人訊息。

 

  1. 共享

我們不會與橫河集團以外的任何公司、組織和個人分享您的個人訊息,但以下情況除外:

(1)在獲取您同意的情況下共享:獲得您的明確同意後,我們會與第三方共享您的個人訊息。

(2)基於軟件及系統供應商完成基本業務功能情形下的共享:隻有共享您的個人訊息,才能提供您所要求的產品和服務,如: 通製特定系統向您發送網絡研討會會議訊息及邀請。

(3)與授權合作夥伴共享:僅為實現本政策中聲明的目的,我們的某些服務將由我們和授權合作夥伴共同提供。我們僅會基於合法、正當、必要、特定、明確的目的共享您的個人訊息,授權合作夥伴隻能接觸到其履行職責所需訊息,且不得將此訊息用於其他任何目的,除非另行獲得您的明示同意。

(4)在法定情形下的共享:我們可能會根據法律法規規定、訴訟、爭議解決需要,或按行政、司法機關依法提出的要求,對外共享您的個人訊息。

 

  1. 轉讓

我們不會將您的個人訊息轉讓給任何公司、組織和個人,但以下情形除外:

(1) 獲得您的明確同意後,我們會向第三方轉讓您的個人訊息;

(2) 在涉及合並、收購或破產清算時,如涉及到個人訊息轉讓,我們會在要求新的持有您個人訊息的公司、組織繼續受本政策的約束,否則我們將要求該公司、組織重新向您征求授權同意。

 

  1. 公開披露

我們僅會在以下情形下,公開披露您的個人訊息:

(1)獲得您明確同意後;

(2)在法律、法律程序、訴訟或政府主管部門強制性要求的情況下,我們可能會公開披露您的個人訊息。

 

三、 我們如何保護您的個人訊息

我們將謹慎對待和保護您的個人訊息,並遵守有關數據隱私保護和數據安全的適用法律。為了保護您的個人訊息的安全和隱私,橫河集團採用內部規則約束我們的員工和管理人員。

若不幸發生個人訊息泄露等訊息安全事件後,我們會立即採取措施阻止安全事件擴大,並按照法律法規的要求,及時告知您。難以逐一告知個人訊息主體時,我們會採取合理、有效的方式發布公告。

 

四、 您如何管理自己的訊息

您可以通製以下方式訪問及管理您的訊息。

 

  1. 訪問、更正和補充您的訊息

您有權訪問、更正和補充您的訊息。

 

  1. 刪除您的訊息

在以下情形中,您可以向我們提出刪除個人訊息的請求:

(1)如果我們處理個人訊息的行為違反法律法規;

(2)如果我們收集、使用您的個人訊息,卻未征得您的同意;

(3)如果我們處理個人訊息的行為違反了與您的約定;

(4)如果您不再使用我們的產品或服務,或您注銷了賬號;

(5)如果我們不再為您提供產品或服務。

若我們決定響應您的刪除請求,我們還將同時通知從我們獲得您的個人訊息的實體,要求其及時刪除,除非法律法規另有規定,或這些實體獲得您的獨立授權。

當您從我們的服務中刪除訊息後,我們可能不會立即在備份系統中刪除相應的訊息,但會在備份更新時刪除這些訊息。

 

3.改變您授權同意的範圍

如果您不想接受我們給您發送的郵件提醒(如網絡研討會的邀請郵件),您隨時可以按照郵件中提供的停止訂閱的方式要求我們停止向您發送此類郵件。

 

4.響應您的上述請求

為保障安全,您可能需要提供書面請求,或以其他方式證明您的身份。 我們可能會先要求您驗證自己的身份,然後再處理您的請求。

我們將在三十個工作日內作出答複。如您不滿意,還可以通製以下途徑投訴:

對於您合理的請求,我們原則上不收取費用,但對多次重複、超出合理限度的請求,我們將視情收取一定成本費用。對於那些無端重複、需要製多技術手段(例如,需要開發新系統或從根本上改變現行慣例)、給他人合法權益帶來風險或者非常不切實際(例如,涉及備份磁帶上存放的訊息)的請求,我們可能會予以拒絕。

在以下情形中,我們將無法響應您的請求:

(1)與我們履行法律法規規定的義務相關的;

(2)與國家安全、國防安全直接相關的;

(3)與公共安全、公共衛生、重大公共利益直接相關的;

(4)與刑事偵查、起訴、審判和執行判決等直接相關的;

(5)有充分證據表明您存在主觀惡意或濫用權利的;

(6)出於維護您或其他個人的生命、財產等重大合法權益但又很難得到本人同意的;

(7)響應您的請求將導致您或其他個人、組織的合法權益受到嚴重損害的;

(8)涉及商業秘密的。

 

五、 您的個人訊息如何在全球範圍轉移

原則上,我們在中華人民共和國境內收集和產生的個人訊息,將存儲在中華人民共和國境內。橫河電機株式會社將可能同時備份您的訊息,以整合橫河集團資源為您提供更優質的服務。同時,Webex Event軟件及系統供應商亦有可能同時備份您的訊息。

由於我們通製遍布全球的資源和服務器提供產品或服務,這意味著,在獲得您的授權同意後,您的個人訊息可能會被轉移到您使用產品或服務所在國家/地區的境外管轄區,或者受到來自這些管轄區的訪問。

 

六、 我們如何處理兒童的個人訊息

在數字化辦公、溝通與協同活動中我們推定您具有相應的民事行為能力。如您為兒童,我們要求您請您的父母或其他監護人仔細閱讀本政策,並在征得您的父母或其他監護人同意的前提下使用我們的服務或向我們提供訊息。

對於經父母或監護人同意而收集兒童個人訊息的情況,我們隻會在受到法律允許、父母或監護人明確同意或者保護兒童所必要的情況下使用或公開披露此訊息。

儘管當地法律和習俗對兒童的定義不同,但我們將不滿 14 周歲的任何人均視為兒童。

如果我們發現自己在未事先獲得可證實的父母或監護人同意的情況下收集了兒童的個人訊息,則會設法儘快刪除相關數據。

 

七、 本政策如何更新

我們的隱私保護政策可能變更。

我們會在本頁面上發布對本政策所做的任何變更。

如該等變更會導致您在本政策項下權利的實質減損,我們還會提供更為顯著的通知(包括對於某些服務,我們會通製電子郵件發送通知,說明隱私保護政策的具體變更內容)。

在各種情況下,如果您繼續使用我們的服務,即表示同意受經修訂的政策的約束。

Privacy Protection Policy

Yokogawa China Co., Ltd. and Yokogawa Electric Corporation (hereinafter referred to as "Yokogawa group" or "we") think your privacy is important. To ensure that you can get a positive user experience while using Webex Event software services and participating in the marketing, live broadcasting, training, seminars, conferences and other activities organized by us on the Webinar network platform, we will help you understand our collection, use, storage and sharing of personal information through the privacy protection policy (hereinafter referred to as "this policy"), as well as the relevant rights you enjoy.

 

.  How do we collect and use your personal information

When you use our website, products and interact with us, we may collect data about you, including your name, telephone number, fax number, email address, nationality, time zone, language used, postcode, detailed address, company name, company website, position and other personal information defined in the Personal information security protection specification (hereinafter referred to as "personal information").

 

We collect your personal information for the following reasons:

to present a Webinar to you;

to provide you webinar information;

to promote our products, services, solutions or successful cases to you;

to perform market data analysis and market promotion services;

to sell, package, deliver our products and invoice;

to provide after-sales service, maintenance and support;

to improve our website and other online services.

 

If you choose to provide us with third-party personal information (such as adding the third party's name, email and phone number to our online conference invitation), you have obtained the third party's permission in advance.

 

.  How can we commission, share, transfer and publicly disclose your personal information

 

  1. Entrusted processing

When we provide products, services or interact with you, some of the content may be provided through our partners. We will sign strict confidentiality agreements with companies, organizations and individuals entrusted by us to handle personal information, requiring them to process personal information in accordance with our requirements, this policy and any other relevant confidentiality and security measures.

We will not share your personal information with any company, organization or individual other than Yokogawa group, except for the following situations:

  1. Share with your consent: With your explicit consent, we will share your personal information with third parties.
  2. Sharing based on software and system suppliers completing basic business functions: Only by sharing your personal information we can provide the products and services you require, such as sending webinar conference information and invitation to you through a specific system.
  3. Share with authorized partners: Only for the purposes stated in this policy, some of our services will be provided by us and authorized partners. We will only share your personal information for legitimate, proper, necessary, specific and explicit purposes. Authorized partners can only access the information they need to perform their duties and shall not use this information for any other purpose, unless otherwise expressly agreed by you.
  4. Sharing under legal circumstances: We may share your personal information with the public in accordance with laws and regulations, litigation, dispute resolution needs, or according to the requirements of administrative and judicial organs.

 

  1. Assignment

We will not assign your personal information to any company, organization or individual except:

  1. With your explicit consent, we will assign your personal information to a third party;
  2. In the case of merger, acquisition or bankruptcy liquidation, if the assignment of personal information is involved, we will require the new company or organization holding your personal information to continue to be bound by this policy; otherwise, we will require the company or organization to seek your authorization and consent again.

We will only disclose your personal information in the following circumstances:

  1. With your explicit consent;
  2. We may disclose your personal information under the circumstances of law, legal proceedings, litigation or mandatory requirements of government authorities.

 

.  How do we protect your personal information

We will treat and protect your personal information with care and comply with applicable laws on data privacy protection and data security. In order to protect the security of your personal information and privacy, Yokogawa group uses internal rules to restrict our employees and managers.

In case of personal information leakage and other information security incidents, we will immediately take measures to prevent the expansion of security incidents and inform you in time according to the requirements of laws and regulations. When it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to release the announcement.

 

.  How do you manage your information

You can access and manage your information in the following ways.

 

  1. Access, correct and supplement your information

You have the right to access, correct and supplement your information.

 

  1. Delete your information

You can request us to delete personal information in the following situations:

  1. If we deal with personal information in violation of laws and regulations;
  2. If we collect and use your personal information without your consent;
  3. If our handling of personal information violates the agreement with you;
  4. If you no longer use our products or services, or you cancel your account;
  5. If we no longer offer you products or services.

If we decide to respond to your request for deletion, we will also notify the entities that have obtained your personal information from us and ask them to delete them in a timely manner, unless otherwise stipulated by laws and regulations, or if these entities are authorized by you independently.

When you delete information from our services, we may not delete the corresponding information in the backup system immediately, but will delete the information when the backup is updated.

 

3. Change the scope of your authorization

If you don’t want to accept email reminders (e.g. webinar invitation emails) we send you, you can ask us to stop sending you such emails at any time according to the way of stopping subscription provided in the email.

 

4. Respond to your request

For security, you may need to provide a written request or other means to prove your identity. We may ask you to verify your identity before processing your request.

We will reply within 30 days. If you are not satisfied, you can also complain through the following channels:

In principle, we will not charge you for your reasonable request, but we will charge a certain cost for repeated requests beyond the reasonable limit. We may reject requests that are unreasonably repetitive, require excessive technical means (e.g., the need to develop new systems or radically change existing practices), pose a risk to the legitimate rights and interests of others, or are highly impractical (e.g., involving information stored on backup tapes).

We will not be able to respond to your request in the following situations:

  1. Related to the performance of our obligations under laws and regulations;
  2. Directly related to national security and national defense security;
  3. Directly related to public safety, public health and major public interests;
  4. Directly related to criminal investigation, prosecution, trial and execution of judgments;
  5. There is sufficient evidence to show that you have subjective malice or abuse of rights;
  6. In order to protect your or other personal life, property and other major legitimate rights and interests, but it is difficult to obtain your consent;
  7. Responding to your request will cause serious damage to the legitimate rights and interests of you or other individuals and organizations;
  8. Involving trade secrets.

 

.  How is your personal information transferred globally

In principle, the personal information we collect and generate within the People's Republic of China will be stored in the People's Republic of China. In order to integrate resources of Yokogawa group and provide you with better service, Yokogawa Electric Corporation will probably back up your information at the same time. At the same time, WebEx Event software and system suppliers may also back up your information at the same time.

In digital office, communication and collaborative activities, we presume that you have the corresponding civil capacity. If you are a child, we ask your parents or other guardians to read this policy carefully and use our services or provide information to us with the consent of your parents or other guardians.

In the case of collecting children's personal information with the consent of parents or guardians, we will only use or disclose such information to the extent permitted by law, with the explicit consent of parents or guardians, or necessary for the protection of children.

Although local laws and customs have different definitions of children, we regard anyone under 14 as a child.
