As such, this Recruitment Privacy Notice (“Privacy Notice”) describes how Yokogawa collects, uses, discloses, transfers, and stores personal data as part of our recruitment process. It also provides information on your rights applicable to our processing of your personal data and how to exercise such rights.

This Privacy Notice applies to all candidates, potential employees, and individuals applying for a role with Yokogawa, at all times during the application and recruitment process.

PART I. GENERAL TERMS

Personal Data We Collect

The types of personal data we may collect and process when you apply for a role with Yokogawa:

  • Identification data and contact details, including your name, photograph, address, email address, phone number and other contact information, gender, date of birth, nationality/ies, national identifiers (such as national ID/passport, or websites.
  • Account registration details, such as email and password.
  • Employment history, such as previous employers and job titles/positions.
  • Background information, such as academic/professional qualifications, job qualifications, education, details included in your CV/résumé (which might include details of any memberships or interests constituting sensitive personal information), transcripts, and employment references.
  • Employment references.
  • Details of your immigration/visa status, such as work authorization.
  • Other information you voluntarily provide throughout the process, including through internal or third-party assessment centers/exercises and interviews.

You can apply for a role at Yokogawa using a number of third-party career sites; for example, SEEK and LinkedIn. Doing so will connect your profile from these systems to your job application.

Personal Data Collected from Other Sources

We typically collect personal data directly from you but there may be situations where we collect personal data from other sources. For example, we may collect the following:

  • Information provided by entities you have asked to support you in finding a job, including recruiting agencies, educational institutions, professional organizations, or alumni resume sharing platforms. 
  • Information provided by Yokogawa personnel who have referred you for a job.
  • Information provided by background-checking agencies, including (where lawful) criminal background checks, and security clearance checks (to the extent applicable to relevant government work) to verify the accuracy of information you have provided.
  • Information provided by referees in response to reference requests.

How We Use Your Personal Data

For Recruitment, Evaluation, Background Screening and Hiring Purposes

We collect and use your personal data primarily for recruitment purposes; in particular, to determine your qualifications for employment and to reach a hiring decision. This includes assessing your skills, qualifications and background for a particular role, verifying your information, carrying out reference checks, security clearance checks or background checks (where applicable), in order to assess your suitability and eligibility for the role for which you applied, and to generally manage the hiring process and communicate with you about it. If we ask you to complete a candidate assessment with a third-party provider, we will include the results in the recruitment process.

If you are successful in the interview process, we may carry out background checks and validation of your experience and academic and professional qualifications. We will use a third-party organization to perform these checks and may share the CV and identity information that you have provided. Background checks will be completed only as permitted by applicable law.

If you accept a role at Yokogawa, the information collected during the recruitment process may form part of your personnel file.

If you are not successful in the interview process, we may keep your details so that we may reach out to you and invite you to apply for other positions that we think may be a good fit for you unless you request that we delete your application.

 

To Comply with Applicable Laws and Regulations and Operate Our Business

In some cases, we may process your personal data to comply with applicable laws and regulations, for example, in certain regions we are required by law to provide reports on the diversity of our recruitment talent pools to the authorities. We may also process your personal data in the performance and organization of our business and internal management, for example to conduct audits and investigations, for mergers and acquisitions, finance and accounting, archiving and insurance purposes and in the context of dispute resolution.

 

To Analyze, Develop and Improve Our Recruitment Activities and Yokogawa Products and Services

In order to analyze, develop and improve our recruiting activities and Yokogawa’s products and services, we may process your personal data, for example if you encountered any problems in using Yokogawa’s recruitment platform or if it is not functioning as expected. We may also conduct surveys and request your feedback on our recruiting activities.

 

To Maintain the Security of Our Information Management Systems

We may process your personal data as necessary to maintain the security of our websites, systems and networks. For example, we may process your personal data when investigating suspicious activity on our sites, systems and networks.

Disclosure of Data

We only disclose your personal data to those who require access to perform their tasks and duties.

Your Rights Over Your Personal Data

In addition to the rights you may have as described in Part I of this Privacy Notice, under the CCPA, you have to right to:

  • Right to request to know about personal data collected, disclosed, shared or sold.
    • To know the categories of personal data that we have collected about you;
    • To know/access the specific pieces of personal data that we have collected about you;
    • To know the categories of sources from which personal data was collected;
    • To know the business or commercial purpose for collecting, or sharing or selling, personal data;
    • To know the categories of personal data that was shared with, or sold to third parties about you; and
    • To know the categories of third parties to whom the personal data was disclosed.
  • Right to Opt-Out of sharing or selling of personal data to third parties
    If we share or sell your personal data to third parties (as sharing, selling and third parties are defined under CCPA) you have the right to direct us to stop sharing or selling to third parties your personal data by submitting a verified request to opt-out of sales of sharing of your information and we will record your instructions. You may submit a request to opt-out of sharing or sales by sending an email to privacydataprotection@yokogawa.com with the subject line “Do not Share or Sell My Personal Information-CA”, you may also submit a request by calling us at 1-(877)-412-1770. Note that at this point in time we do not share or sell your personal data to third parties.

You may submit a request to know, correct, limit the use/disclosure, or delete through or by calling us at 1-(877)-412-1770 Please note that any requests may be subject to verification of the identification of the requestor. The method we would use to verify your identity will be different depending on the manner and context in which your data was collected and may require the provision by you of such personal data as may be necessary to match you to our records of you (if any). You may be entitled to use an authorized agent to exercise your rights on your behalf and, if you choose to do so, such an agent may contact us in the same manner as described above and will also be required to satisfy our verification of its own identity and its authority to act on your behalf.

BRAZIL

The General Personal Data Protection Law, Law No. 13,709/2018 (the LGPD) and its relevant regulations and rules apply (i) when your personal data (“Personal data” as used and defined in the PIPA) is processed by a Yokogawa Affiliate located in the Brazilian territory, (ii) if you are located in the Brazilian territory, (iii) when the processing concerns personal data collected in the Brazilian territory, or (iv) when the objective of the processing is to offer or supply goods or services to individuals located in the Brazilian territory.

Legal Basis for Processing Personal Data

The Brazilian General Data Protection Law requires us to provide you with information on the legal basis of the processing of your personal data, which are: Article 7 V LGPD (“Contract Performance”) – e.g. to take steps at your request prior to entering into a contract; Article 7 II LGPD (“Compliance with Legal Obligations”); Article 10 I and II LGPD (“Legitimate Interest”) – e.g. to manage the hiring process and communicate with you about it, or to analyze, develop and improve our recruiting activities and Yokogawa’s services; Article 7 I LGPD (“Consent”) - e.g. we process information you provided us with your application, which are not required by the job advertisement.

The Personal Information Protection Act (the ‘PIPA’) and its relevant regulations and rules apply (i) when your personal data (“Personal Information” as used and defined in the PIPA) is processed by a Yokogawa Affiliate located in the Republic of Korea, or (ii) if you are located in the Republic of Korea and your Personal Information is processed by us for the purpose of providing you with services or products.

Yokogawa does not provide Personal Information to Yokogawa Affiliates and/or third parties without your consent, unless otherwise permitted by applicable laws.

Currently, Yokogawa provides Personal Information to Yokogawa Affiliates with your consent. The details of such provision are as follows

  • Recipient: Yokogawa Affiliates (including the Yokogawa Affiliate company to which you are applying)
  • Country of the recipient: Please refer to the list of Yokogawa’s Affiliates in Part I of this Privacy Notice.

Overseas Transfer of Personal Information

The recipients of your Personal Information may be located overseas. See list of Yokogawa Affiliates and third-party data processors located overseas in Part I of the Privacy Notice. When transferring your Personal Information overseas, Yokogawa stipulates the matters necessary for the recipient to safely process Personal Information and carries out supervision to ensure safe processing in accordance with the PIPA.

You may decline to consent to overseas transfer of your Personal Information. However, if you decline to consent, you may not be able to apply for a role with Yokogawa.

Procedures and Methods for the Destruction of Personal Information

The procedures and methods for the destruction of Personal Information are as follows:

  1. Destruction procedure: If the retention period as described in the section “Data Retention” under Part I of this Privacy Notice expires, Yokogawa will immediately destroy the relevant Personal Information.
  2. Destruction method: Personal information printed on paper will be shredded by a shredder or destroyed by incineration, while Personal Information stored in electronic file format will be deleted using technical means that cannot regenerate the record.

REPUBLIC OF SOUTH AFRICA

When personal data (“Personal Information” as used and defined in the POPIA) processing occurs by a responsible party (i) regarding Personal Information in the Republic of South Africa (the “Republic”), (ii) domiciled in the Republic, or (iii) not domiciled in the Republic but makes use of automated means or non-automated in the Republic of South Africa, South Africa’s Protection of Personal Information Act (POPIA) applies.

Your Rights Over Your Personal Information
The right to raise a complaint to a data protection authority about our collection and use of your Personal Information, as explained in Part I, can be exercised by using the relevant form prescribed by the Information Regulator, and sending the completed form to: POPIAComplaints@inforegulator.org.za.

MIDDLE EAST AND AFRICA

When personal data processing occurs (i) by a responsible party located in the countries under the control of Yokogawa Middle East & Africa B.S.C, being: the United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Bahrain, Oman, Egypt, Algeria, Morocco, Tunisia, Congo, Angola, Nigeria, and Mozambique (the “YMA Region”), or (ii) concerns personal data of individuals located within the YMA Region, the Data Protection Laws applicable to the relevant country within the YMA Region applies.

Legal Basis for collecting, processing and /or Transferring your Personal Data

Notwithstanding the provisions of the Privacy Notice in this regard, and to the extent required under the applicable Data Protection Law, we will obtain authorization from, or notify the relevant Personal Data Protection Authority before collecting, processing and /or transferring your personal data.

If the collection, processing and/or transfer of your personal data, is conditioned to certain requirements under the applicable Data Protection Law, such as the appointment of a data protection officer, external auditor, obtention of a license, or otherwise, we will comply with such requirements before proceeding with any collection, processing and /or transfer of your personal data.

If required - under the applicable Data Protection Law - to draw up a document setting the security measures, rules, and procedures applicable to the collection, processing and/or the transfer of your personal data, detailing the security levels, the resources to be protected, and the duties and responsibilities of the persons accessing to your personal data, such as standard contractual clause “SCC” or binding corporate rules “BCR, we will be complying with the same before collecting, processing and/ or transferring your personal data.

If your personal data is processed by a third party, we ensure that we shall select a service provider that can give us sufficient guarantees in respect of technical security measures to protect your personal data. If required under the applicable Data Protection Law, we commit to enter in a written contract that binds us with the service provider, to ensure that such service provider will act solely under our instructions

Collection, Processing, and Transfer of your Sensitive Personal Data

If the collection, processing, and/or the transfer of your sensitive personal data or certain sensitive personal data is restricted or not permitted under the applicable Data Protection Law, we will not be requesting you to provide such sensitive personal data.

If the collection, processing and /or the transfer of sensitive personal data is conditioned to observe specific requirements under the applicable Data Protection Law, such as the obtention of an authorization from the relevant Data Protection Authority, we will be observing the same before collecting, processing and/or transferring your sensitive personal data.

Use of your Personal Data

Except as specified in this Privacy Notice, we commit that we will not use your personal data for other purposes without your prior written approval.

Disclosure of your Personal Data

Notwithstanding the provisions of the Privacy Notice, and to the extent required under the Data Protection Applicable Law, we hereby ensure that only the authorized persons will be entitled to access your personal data.

If required under the applicable Data Protection Law, we will:

  • Create different levels of access permissions, on a need-to-know basis, depending on the position of the authorized persons that are entitled to access your personal data.
  • Ensure the identity of the persons who want to access your personal data or the identity of the parties to whom your personal data will be disclosed.
  • keep a record of who accesses your personal data, time of access, and reason of access to ensure traceability of its use.

Retention of your Personal Data

Notwithstanding the provisions of the Privacy Notice in this regard, we will delete your personal data once the purpose for which your personal data was collected is achieved, or as otherwise required by applicable Data Protection Laws.

If you are not successful in the interview process, we will delete your personal data, unless you agree to maintain such data, so that we may reach out to you and invite you to apply for other positions that we think may be a good fit for your profile.

Personal Data Infringement

Notwithstanding the security measures that will be taken by us under the Privacy Notice, and to the extent required by the applicable Data Protection Law, we shall immediately, upon becoming aware of any infringement or breach of your personal data, report such situation and the results of our investigation (including our actions of remedy and the timeframe of remedy), to you / and or the Data Protection Authority (as applicable).

PEOPLE'S REPUBLIC OF CHINA

The Personal Information Protection Law and its relevant regulations and rules (collectively, “PIPL”) of the People’s republic of China shall govern when personal data (“Personal Information” as used and defined in PIPL) collection and processing (i) occurs in China, or (ii) concerns Personal Information of individuals located within the territory of China for the purpose of providing services or products or analyzing and evaluating the individual’s behavior.

Lawful Basis for Processing Personal Information

Yokogawa processes your Personal Information pursuant to the following lawful bases in accordance with the PIPL:

Consent – Yokogawa processes your Personal Information pursuant to your consent (your acceptance to this Privacy Notice). Yokogawa may also process Personal Information based on other legal grounds such as:

Contract Conclusion or Performance – Yokogawa processes your Personal Information in order to conclude a contract with you or your organization upon your request or exercise its rights and perform its obligations under a contract with you.

Compliance - Yokogawa processes your Personal information in order to perform or comply with its legal or regulatory obligations.

Disclosed Personal Information - Yokogawa may process your Personal Information that is already disclosed by you or otherwise lawfully disclosed, within a reasonable scope in accordance with the PIPL, and the processing of Personal Information is not expressly rejected by you and has no significant impact on your personal rights and interests.

Public Interest – when Yokogawa performs necessary actions in the public interest and the Personal Information is processed with reasonable limits.

Cross-Border Transfer

We use a global Human Recourse Management System within the Yokogawa Group. This may result in the transfer of some of your Personal Information between various Yokogawa Affiliates located in different countries. Also, it may involve overseas information processing service providers designated by Yokogawa from time to time.

In accordance with the requirements of PIPL, we will take necessary technical measures, such as encryption during the transmission process and conclude Personal Information transmission /processing agreement with the information recipient or co-processor to clarify the rights and obligations between the parties concerning your Personal Information and ensure the security of your Personal Information during cross-border transmission and processing.

Your Rights Over Your Personal Information

In addition to the rights you may have as described in Part I of this Privacy Notice, under the PIPL, you have the following rights relating to our processing of your Personal Information:

  • You may request us to explain our Personal Information processing rules when necessary.
  • You may request to delete your personal Information:
    •If we process your Personal Information in violation of laws and regulations;
    •If we collect and process your Personal Information without your consent;
    •If our processing of Personal Information violates an agreement with you;
    •If you withdraw your consent;
    •If you no longer use our products or services, or you cancel your account;
    •if we no longer offer you products or services.

If we decide to respond to your request for deletion, we will also notify the entities that have obtained your Personal Information from us and ask them to delete them in a timely manner, unless otherwise stipulated by laws and regulations, or if these entities are authorized by you independently.

When you delete Personal Information, we may not delete the corresponding Personal Information in our backup system immediately but will delete the Personal Information when the backup is updated.
